ELKINS — A Maryland man was booked into the Tygarts Valley Regional Jail on Wednesday after police say he sent and received explicit material to a Randolph County juvenile.
Brent Nikota Bittner, 18, has been charged with four felonies including distribution and display to minor of obscene matter; use of obscene matter with intent to seduce minor; use of minors in filming sexually explicit conduct prohibited; and employment or use of minor to produce obscene matter.
The criminal complaint states that the offense did occur within Randolph County due to the victim’s presence in the county during the time that the offenses were committed, even with Bittner’s location being in Cumberland, Maryland.
Back in February of this year, the father of the 9-year-old victim made a complaint at the Elkins Detachment of the West Virginia State Police after seeing sexual content on the victim’s snapchat account.
The report says that police observed within the conversation between the victim and the accused, several instances of solicitation for naked photographs and explicit videos.
During the investigation, police were able to find and locate Bittner through administrative subpoenas and a TLO report (online investigative system). During his interactions with the juvenile, Bittner was only identifying himself by online names and identifications.
During a forensic interview with the juvenile back in February, the victim stated that he first met the suspect on Omegle, an application and website used to talk to strangers. The victim stated that he also played video games with the suspect one or two times a week.
The juvenile stated that shortly after befriending the suspect, the suspect started sending explicit pictures to him on Snapchat. The victim stated that the suspect threatened him and told him that he had to send pictures back. The victim said that the suspect would send explicit photos with two different Snapchat accounts, and the suspect always used a filter to hide his face.
The complaint says that the suspect would ask the victim every day for explicit photos and videos. The victim also said that the suspect would take a screenshot or save every video he sent.
Earlier this month, Trooper First Class Austin H. Clark, who was the investigating officer, received an electronic delivery of data from Snap Inc. in response to a search warrant submitted. This data led to many findings and confirmed allegations made by the juvenile.
The criminal complaint says that one of the explicit photographs that the victim sent to the suspect was shared with another user on Snapchat. This count of distribution of child pornography occurred outside of the police’s jurisdiction within the State of West Virginia and will be forwarded to authorities in the suspect’s jurisdiction.
Bittner is being held at TVRJ on a $100,000 cash-only bond.
