FAIRMONT — A Granada man is facing multiple felony charges in Martin County. Dale Roy Dailey II, 29, has been charged with one count of assault in the second degree which carries a maximum penalty of seven years in prison and a $14,000 fine.

He is also charged with two counts of making terroristic threats, each of which carries a maximum penalty of five years in prison and a $10,000 fine. Finally, Dailey is charged with one count of drug possession in the fifth degree, which carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint:

At approximately 1:12 p.m. on May 23, 2021, a deputy with the Martin County Sheriff’s Office was dispatched to the Bar and Grill business in Granada on a report of an assault with a knife. Upon arrival, the deputy spoke with a man and a woman. As they were talking a male party identified as Dailey entered the building by the back door.

It appeared that Dailey was agitated and he indicated he wanted to press charges against the man for pushing him. The deputy spoke with Dailey outside of the business.

Dailey indicated he lives alone above the business and indicated that the woman told people his apartment smells like marijuana. Dailey did not appreciate this and he confronted her about the issue. He indicated that he had a confrontation with the man and woman.

Dailey indicated that he was walking his dog and the woman was outside the business smoking a cigarette. He also indicated that the man was with the woman and put out his hands as if he wanted to fight.

Dailey indicated that he and the man walked toward each other and met in the alleyway. He indicated they were face to face and words were exchanged, and that the man placed his hands on his chest and pushed him. The deputy observed that Dailey was angry.

The deputy then spoke with the other man, who advised there was an argument. He stated that Dailey had walked into the bar with his dog and stated he was going to knock the woman’s teeth out. He then indicated that there was an altercation between himself and Dailey outside.

He indicated that he was face to face with Dailey and that Dailey pulled a knife on him. He indicated the blade was about three to four inches long and had a wooden handle. He indicated Dailey kept the knife near his side and told the man that he would be placed in a body bag and his family could see him at his grave.

Deputies spoke with an individual who was near the bar at that time. The individual indicated she saw the men arguing with each other, but advised they did not see a knife.

The deputy placed Dailey under arrest and transported him to the Martin County Jail. During the transport, Dailey was yelling and banging on the back cage of the squad vehicle. The deputy was forced to stop the vehicle due to Dailey’s disorderly behavior.

The deputy applied for a search warrant of Dailey’s apartment, which was granted. The deputy executed the search warrant and was let into the apartment by an acquaintance of Dailey’s.

The individual advised that if Dailey had a knife it would be in the top right kitchen drawer, and indicated that Dailey’s knife has a large wooden handle on it with Dailey’s name inscribed.

Deputies did not discover the knife but did locate a substance that appeared to be THC wax in two glass jars. The deputy applied for another search warrant and retrieved the THC wax.
